GENERAL PROVISIONS

Welcome to Soodnesoojus. The terms “we”, “us”, and “our” refer to Soodnesoojus, a company operating in accordance with the laws of the Republic of Estonia and the European Union.

Soodnesoojus operates this online store and website, including all related information, content, features, tools, products, and services (collectively, the “Services”). The Services are provided using the Shopify platform.

These Terms of Use (“Terms”), together with any policies referenced herein, describe your rights and obligations when using the Services.
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy [LINK].

If you do not agree to these Terms, you must not use the Services.

SECTION 1 — LEGAL CAPACITY AND ACCOUNT

By using the Services, you confirm that you are at least 18 years old or otherwise have full legal capacity under the laws of your country of residence.

To use certain features of the Services, including placing orders, you may be required to provide personal data such as your name, email address, payment details, and address information. You confirm that all information you provide is accurate, complete, and up to date.

You are responsible for maintaining the confidentiality of your account login credentials and for all activities conducted through your account. Transfer or assignment of your account to third parties is prohibited.

SECTION 2 — PRODUCTS AND INFORMATION

We make reasonable efforts to ensure the accuracy of product descriptions, images, and prices. However, product images are for illustrative purposes only, and the actual appearance of the product may vary slightly due to technical display differences.

Product descriptions may be updated at any time. Such updates do not affect orders that have already been confirmed.

Nothing in this section limits your mandatory consumer rights under EU and Estonian law, including rights relating to product conformity and statutory guarantees.

SECTION 3 — ORDERS AND CONTRACT FORMATION

Placing an order constitutes your offer to purchase a product. A binding sales contract is formed only once we send you an order confirmation by email.

We reserve the right to refuse or cancel an order in cases permitted by law, including pricing errors or product unavailability. If payment has already been made, it will be refunded without undue delay.

SECTION 4 — PRICES AND PAYMENT

All prices are stated in euros (€).
Unless otherwise specified, prices include value-added tax (VAT) applicable in Estonia or under EU VAT rules.

Shipping costs and any additional charges are displayed before order confirmation.

You agree to provide valid payment information and authorize the charge of the full order amount.

SECTION 5 — DELIVERY

Stated delivery times are estimates only. We are not responsible for delays caused by carriers, customs procedures, or circumstances beyond our control.

The risk of accidental loss or damage to the goods transfers to you only upon actual delivery, in accordance with EU consumer protection law.

SECTION 6 — RIGHT OF WITHDRAWAL (EU CONSUMERS)

If you are a consumer in the European Union, you have the right to withdraw from the purchase within 14 days without providing any reason, in accordance with Directive 2011/83/EU.

SECTION 7 — INTELLECTUAL PROPERTY

All content of the Services, including text, images, logos, design, and trademarks, is owned by Soodnesoojus or used lawfully and is protected by EU and international intellectual property laws.

The Services may be used solely for personal, non-commercial purposes. Any other use requires prior written consent.

SECTION 8 — THIRD-PARTY SERVICES AND LINKS

The Services may contain links to third-party websites or tools. We do not control and are not responsible for their content, policies, or practices.

Use of third-party services is at your own risk.

SECTION 9 — PRIVACY AND DATA PROTECTION

Personal data is processed in accordance with:

  • The EU General Data Protection Regulation (GDPR)

  • The Estonian Personal Data Protection Act

SECTION 10 — REVIEWS AND FEEDBACK

By submitting reviews or feedback, you grant us a non-exclusive, royalty-free license to use such content for marketing and operational purposes, to the extent permitted by law.

This does not affect your moral rights, where applicable.

SECTION 11 — ERRORS AND CORRECTIONS

We reserve the right to correct errors or inaccuracies. This does not affect your statutory rights or confirmed orders.

SECTION 12 — PROHIBITED USE

You must not use the Services for unlawful purposes, including fraud, infringement of intellectual property rights, or distribution of malicious software.

We may suspend or terminate access to the Services in accordance with applicable law.

SECTION 13 — LIMITATION OF LIABILITY

Nothing in these Terms limits or excludes liability where such limitation is prohibited under EU or Estonian law, including liability for:

  • Death or personal injury caused by negligence

  • Fraud or intentional misrepresentation

  • Breach of mandatory consumer guarantees

In all other cases, liability is limited to the extent permitted by law.

SECTION 14 — INDEMNIFICATION

You agree to indemnify Soodnesoojus for losses resulting from your unlawful use of the Services, to the extent permitted by law.

SECTION 15 — SEVERABILITY

If any provision is found invalid, the remaining provisions shall remain in full force and effect.

SECTION 16 — GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Republic of Estonia and applicable European Union law.

All disputes shall be subject to the jurisdiction of the courts of Estonia.
EU consumers may also use the EU Online Dispute Resolution (ODR) platform.

SECTION 17 — CHANGES TO THE TERMS

We may update these Terms in accordance with legal requirements or changes to our operations.

Material changes will be communicated to users where required by law.
